Bulgaria: Bulgaria Justice Ministry Says Jeleva Made No Violation - Report

Bulgaria’s EU Commissioner-Designate Rumiana Jeleva has made no legal violation in reporting her financial situation, according to a document issued by the Bulgarian Justice Ministry.

The document is signed by Bulgaria’s Deputy Justice Minister, Lyudmila Petrova, and has been cited and reprinted by New Europe – available HERE in Bulgarian on the media’s website. (www.neurope.eu).

Bulgaria’s EU Commissioner-Designate Jeleva has been accused of being involved in a conflict of interests in 2007-2009 when she was simultaneously a Member of the European Parliament, and a manager and owner of the Global Consult firm.

The cited report of the Bulgarian Ministry of Justice says that at the time Jeleva became an MEP – April 2007 – there was no law in Bulgaria banning Members of the national Parliament from carrying out commercial activities. The only such limitation was included in the statutes of the National Assembly but this did not apply to Bulgaria’s first MEPs elected in 2007.

The points out that the Prevention and Exposure of Conflict of Interests Act was only adopted in October 2008 and entered into force on January 1, 2009. Thus, at the time Jeleva was an MEP, there were no legal provisions in Bulgaria making it incompatible to hold that post and be in charge of commercial activities at the same time.

The Justice Ministry further states that as an MEP, Jeleva was not even obliged to submit a declaration under the law for transparency of the personal assets of high-ranking officials but that anyway.

The Ministry concludes that Bulgaria’s Foreign Minister Rumiana Jeleva has not made any violations of the national legislation referring to conflict of interests.

The conlfict of interests allegations were raised by a number of MEPs during Rumiana Jeleva's hearing at the EP Development Committee on Tuesday, January 12; her performance has been evaluated as unconvincing.

The EP has EC President Jose Manuel Barroso to make public his position by the end of the day on Friday as to whether Jeleva was involved in conflict of interests.
