The regional court in the Bulgarian town of Haskovo refused to extradite to France Fritz-Joly Joachin on charges of abduction.
The court has to decide on the request for his extradition on the basis of two European Arrest Warrants (EAW) – one concerning an attempt of kidnapping his child and the other one on terrorism, electronic daily Dnevnik reports.
The court ruled against his extradition on grounds of abduction, as the Bulgarian legislation does not provide punishment for such a crime.
Fritz-Joly Joachin confessed himself guilty on this charge and requested extradition to France.
His wife submitted a signal at the end of 2014, that her husband was attempting to take their three-year-old son to Syria.
According to French investigators, the suspect was planning on initiating his son in the ideas of radical Islam.
The court postponed its ruling on the accusations of terrorism for Tuesday.
After he was detained, Fritz-Joly Joachin confessed that he had had connection with one of the Kouachi brothers, who carried out the terrorist attack against the French satirical weekly Charlie Hebdo last week.
Joachin was detained on January 1 at the Kapitan Andreevo border checkpoint while he was attempting to cross from Bulgaria to Turkey.
