The rule of the Sofia City Court to return "The Impudent" case back to the prosecutor over procedural violations bears no drama, according to Sofia City Prosecutor, Nikolay Kokinov.

It was reported earlier the magistrates sent back the charges over the lack of an order to partially annul one of them, against an alleged member of the kidnap gang. Kokinov blamed the file clerk for failing to attach the above said document, but did not name her.

He showed the document in question to reporters, saying nothing else triggered the Court's decision, reassuring it would be applied to the case ASAP.

The other reason behind the magistrates' move was a wrongful charge against a different gang member for causing light bodily injury because the injured person never filed a claim for it, which is a requirement to press such charge.

The incident happened during the alleged criminal's resisting arrest when one of the policemen shot himself in the hand while trying to enter a blocked door. The policeman never filed a claim.

Kokinov stated this charge was consciously pressed in order to avoid its appeal and drag on the case with the expectations the Court would annul it.

"I am not offended by anyone, but I am surprised that the Court's rule to return the case was leaked to the media before I even saw it," the Prosecutor said, adding his office was in a hurry to press charges not over the deadlines imposed by Interior Minister, Tsvetan Tsvetanov, but over the huge public interest.

Kokinov's words came on the heels of numerous accusations against magistrates, who have released several detainees in high-profile criminal cases.

The alleged criminals were arrested on December 16, 2009. The police operation was carried out in the cities of Sofia, Veliko Tarnovo and Montana and resulted in 27 detentions.

"The Impudent" are implicated in 11 high-profile kidnappings terrorizing Bulgarians in the last years.

On September 8, Bulgaria's Prosecutor's Office pressed official charges against nine of those individuals arrested during the special police operation under the same codename.

Ivaylo Evtimov and Prokopi Prokopiev were charged with racket and with organizing a kidnap gang.

Daniel Dimitrov, Lyubomir Dimitrov, brothers Radoslav and Mitko Lebeshevski, Pavel Petkov, Kiril Kirilov, and Tsvetozar Slavchev, were all charged as accessory to the abductions.
