Commenting article: Sofia Court Postpones Decision on Extradition of Technomarket Co-founder to Italy

The Sofia City Court has postponed by a month the decision on the extradition to Italy of Nikolay Kitov, Member of the Board of Directors of Bulgarian consumer electronics retailer Technomarket.

Kitov, who faces tax fraud charges, was arrested in Sofia on July 7. A few days after the arrest, he was released on a bail of BGN 10 000.

The judge panel of the Sofia City Court sided with the claim of the defense that Italian authorities had not presented sufficient information about the facts related to Kitov’s participation in the offense over which his extradition has been requested.

Maybe, I could understand that Bulgarian court needs additional clarification from Italian authorities. Stretching it a bit more, I could understand Mr. Kitov can be released on bail. What I do not understand is how Bulgarian courts can justify applying such ridiculously low bail amount, disproportionate to Mr. Kitov's net worth and the severity of the accusations!

Again, the Bulgarian court has contributed to the impunity of their fellow criminal citizens, simply because they were told to do so.

A list of procedure mistakes? always easy to find.

"to guarantee that after the hearing in Italy Kitov would be returned to Bulgaria to serve the detention on remand and the potential sentence in Bulgaria." READ: "House arrest"

Mr. Kitov's comments:

"the case targeted Bulgarian export in general because it criminalized the activity of Bulgarian exporters"
"allowing this to happen would be an unprecedented occurrence which would deal a blow to all export companies in Bulgaria"

Mr. Kitov assumes that the Bulgarian exporters sell to VAT carousels? And why is Technoma. - a retailer - selling to Italy?

“Sales between companies based in the EU are VAT-free, meaning that the Bulgarian company stands no chance of stealing VAT,”

It is all about stealing VAT from Italy, not from Bulgaria!

TM sells to company X (It -VAT free), X sells to Y (It-VAT),Y sells to Z (It-VAT) and Z sells to BG (No VAT). Z recovers the VAT. Company X and Y disappear. Z is rich, and off course Z is related to TM. (this is a simplified example, normally there are some off shore companies and a bank (the platform) involved. Mr. Kitov was very close to Tsv. Vas..

Anyway, Mr Kitov will have impunity, off course he will have to kiss the PM's hand.

Bravo BG courts! These Italian bullies will not succeed in their attempts to extradite our innocent businessmen and put them in front of a corrupt kangaroo court in Italy. Our magistrates set an example of jurisprudence that puts the rest of the world to shame.
