The captain of the Cypriot cruise ship sank Friday in a bay off the Greek island of Santorini as well as five other officers were accused of causing the wreck because of their carelessness.
They were charged also with violating the international security regulations.
The members of the crew were arrested and later released as the investigation is still in progress.
The ship Sea Diamond, owned by Cypriot cruise liner and hotel operator Louis Plc, started to list after hitting a rock as it attempted to enter the port of Santorini.
Two of the passengers have not been found yet.
Greek air force and navy helicopters, two cruise ships, a ferry and local craft from Santorini assisted in the successful and orderly evacuation of the other tourists on board.
The survivors, 12 Bulgarians among them, were then transferred by ship to the Greek mainland port of Piraeus.
