The company Roche Bulgaria had fully adhered to the law in the contract for the supply of the anti-viral flue medicine Tamiflu during the public tender announced by Bulgaria's cabinet.

The company issued an official declaration Tuesday in connection with prosecutor's charges against the Health Minister, Bozhidar Nanev, which stem precisely from the above said contract. Nanev resigned just hours after being called to the Prosecutor's Office.

The price, proposed by Roche is in compliance with the requirements of the normative act i.e. it is not higher than the established price included in the so-called Positive Doctor's List.

Roche declined comments on the offer that has been made by the UK government, which is said to have been lower by BGN millions.

The company's declaration further lists facts and details about the tender:

Om November 3, 2009, the Health Ministry published an announcement about a public tender for the supply of two anti-viral medications to treat swine flu – oseltavamir marketed by Roche as Tamiflu and zanavamir known as Relentza. Roche decided to take part in the tender with a price offer of BGN 31.88 for a package of Tamiflu with a total of 150 000 packages. The price not only complies with the normative act, but is the lowest among all other referenced countries (the Czech Republic, Hungary, Lithuania, Estonia, Greece, Spain and Portugal). The Value Added Tax (VAT) and the wholesale merchant's surplus charge have been included in the price.

The contract between Roche and the Health Ministry has been signed on December 16, 2009.

On November 11, 2009, the Health Ministry announced another public tender for an additional supply of oseltamavir. Roche offers to provide 50 000 packages for the same price of BGN 31.88 per package. The second contract is also signed on December 16, 2009.

The medicine from both contracts has an August 31, 2016 expiration date.
