An Israeli court has confirmed that Holocaust survivors from Bulgaria who were confined to their homes during World War II will be entitled to survivors' compensation from Israel.

The Tel Aviv District Court accepted Monday the survivors' position, rejecting an appeal by the Finance Ministry, haaretz.com reported Wednesday.

In the precedent-setting decision on a case filed by a group of survivors from Bulgaria and Romania, the court instructed the Finance Ministry to take a liberal attitude in considering survivors' applications for compensation in such cases. The bench also criticized delays in dealing with requests and ordered the authorities to begin processing them immediately.

"This decision will lead to the recognition that thousands of Holocaust survivors who were confined are entitled to compensation," attorney Ilan Yakobovich, representing the survivors, said.

Judges Issaiyho Schneller, Kobi Vardi and Ruth Lebhar-Sharon ruled that applicants would have to meet an additional criterion to be eligible for compensation: They will have to show that they were confined beyond the hours of curfew and had limited freedom of movement.

Following the ruling, applicants who had previously been turned down can now reapply for compensation.

After World War II ended, Jews from Romania and Bulgaria began filing for compensation from Germany for the years when the regimes in their home countries confined them to their homes for up to 20 hours a day.

However, the Germans turned them down on the basis that their freedom had not been revoked under the definitions of the law.
