So...JOE ANDERSON ingnores ALL RULES OF EVIDENCE and proclaims 1) as

JUSTICE HIS OWN FEELINGS AND ITUTITION?!

WHO IS JOE ANDERSON? A poltician, who is CHASING the votes of the electorate in

Liverpool!

And SOON,very SOON there are elections in his constituancy.,which consists 90% of Labor followers.

WHY POLITICISING THE CRIMINAL LAW AND CRIMINAL PROCEDURE ,Mr.Joe Anderson?

He is talking RUBBISH! ID EVIDENCE is not admissible in UK Criminal Courts...that is what he says.

Firstly it is NOT named ID evidence but TESTIMONIAL EVIDENCE...evidence elicited from a witness.

Such a type of evidence is admissible in ALL Western jurisdictions.

2)" The Bulgarian system(he probably means judicial system) is barbaric."

HOW DOES HE KNOW? DID HE STUDY LAW IN BULGARIA? DID HE WORK AS AN

ATTORNEY OR AS A JUDGE OR PROCURATOR IN BULGARIA?

If Michael Shilds felt innocent,WHY HE DID NOT REQUIST THROUGH HIS DEFENCE

AN APPEAL?

Of course the BG system allows NEW evidence but ac.to the Criminal Ptrocedure it can be produced ONLY in a trial...

NOT in the office of the Leader of UK Labor Party!!!!

After a sentence was issued,a NEW trial in Criminal law could be initiated by Shild's attorney.

The BG Attorney General is obliged acc. to Criminal Procedure to re-open a trial ONLY if he is presented with new facts, which must give grounds for starting a NEW TRIAL.

A person, named SPANKEY,wrote a statement(confesion) at the Police but later withdrew this so called confesion.

And this happens in UK,NOT in Bulgaria.

If the UK Police charged SPANKEY with some kind of criminal activity,BG could require EXTRADITION...but how in the world could te BG Procurator DEMAND,that UK Government delivers Spankey to Sofia?

HE HAS NOT BE CHARGED WITH ANYTHING!

3)If Shild thinks he is innocent,WHY HE DOES NOT ASK BG TO REOPEN THE TRIAL?

Again the English show their prejudice, that Bulgaria as a small country(and somewhere there on the wartorn BALKANS) could NOT possibly have

a PROPER JUDICIAL SYSTEM!

HOW DO THEY DARE!

Bulgaria existed as a STATEHOOD looooooooooooooooooong before the word ENGLISH existed!

When the English were still wearing lathr skins and hunting wild animals!

THE ROMANS WERE WHO tought them CIVILISATION AND ESTABLISHED THEIR JUDICIAL SYSTEM on this foggy island!

Even up til today, their LAWS are ROMAN laws...I just had a case in UK Conveyancing law.

Many times I have also divorce cases...UK citisens, living in Germany, who are divorcing here.

The German Family Law allowes couples to use their NATIVE divorce law,EVEN if they use a German court.

And he is RIGHT!

Judges are trained to be INPARTIAL,NEUTRAL!

A judge ought to ANALYSE,INTERPRET THE RULES and look for precedent cases,if there

is not black letter law.

A judge should NOT be emotional, when making decisions...HE SHOULD NOT BE BIASED!

In contrary the PROSECUTOR is ORGAN OF the state...

his role is to ACUSE,TO CHARGE the suspect ,if commited an actus reus.

He ought to be aggressive, bold and ASSERTIVE.

USUALLY judges and prosecutors have very differnt characters, therefore they complement each other.

Hello Ivanko,

you could save yourself the OBCENE words.

I do not know about high prices for hotels in BG.

Here,in Germany Bulgaria is promoted as a VERY low budget URLAUBSLAND.

Sometimes you get for€269,-flight+hotel for 7 days.

Fact is:EVERY COUNTRY,which invested PREDOMINANTELY in the TOURIST SECTOR,

at some point had problems.

The TOURIST INDUSTRY is a ciclical industry...when there is arecession, people simply

CUT on HOLIDAYS!

My dearest Geljaskov,

YOU ARE REALY NAIVE...

DO YOU THINK THE WEST GREAT POWERS WILL ALLOW BULGARIA TO BUILD NUCLEAR

PLANS?

JUST TWO DECADES AGO BULGARIA WAS A COMMUNIST COUNTRY AND BEHIND THE

IRON COURTAIN!

As for tourism you are right...Bulgaria should NOT invest a lot in tourism at the moment, because there is a world recession and people(especially low budget people) can not afford to go on holidays.

A COUNTRY IS LESS VULNERABLE TO WORLD ECONOMIC CRISES WHEN IT's

economy is DIVERSE;DIVERSE AND AGAIN VERY diverse.

Develope ALL BRANCHES of the economy.

CJR,

WHY ARE YOU SOOOOOOOOOOOOOOO ARROGANT?

"Exactly! So shut up and do not pretend you know....!"

TO YOUR INFORMATION ...THIS AS A PUBLIC FORUM AND EVERYBODY WHO

WISHESTO AIR HIS/HER OPINION IS MORE THAN FREE TO DO SO.

I did not say that Russua ought to sue BG as I do not know details about this case.

You were the ONE,who started this topic and I JUST aired my opinion, that if Bulgartabak were owned by USSR,

than probably Russia as a successor of USSR would have had a claim.

STEALTHY,

I do not know what you mean by saying:" Russia do not recognise any claims by

other states for property of USSR abroad and on the territory of USSR"?

The sentence does not make sense.

IEXUSE ME I DID NOT STUDY RUSSIA'S STATE LAW...I studied German

Grundgesets and USA Contract,Criminal ,Wills &TRUSTS a.s.o.

As far as I know Russia inherited all legal obligations of USSR to the International commuity.

I drew a paralel to FEDERAL REPUBLIC OF GERMANY (BRD),which after the WWII

took over all legal claims of foreign entities and PAID MILLIONS FOR RESTITUTION

TO THE ISRAELI STATE or other European states.

And what the Bolsheviki have to do with Bulgartabak?

I do not know if they paid any restitution to the companies, who had had propety

in Russia.

The fact that I studied Law does NOT make me an expert in the LAW OF EVERY

COUNTRY!

Legally Russia is successor of USSR as Moskow was the capital of USSR.

Therefore Russia would have an LEGITIMATE CLAIM against BG ,if Bulgartabak

realy belonged to it.

It is questionable that they did NOT come on this idea until now.

THey should ask in advance how much is the fare from the Airport to the Government House.

Even in LONDON I always ask the taxidriver:"How much you will charge me

Mr.So&So for the trip from my hotel to Gatwick?"

If he wants more at the end of the trip,HE DOES NOT GET ANYTHING;NADA!"
