Commenting article: Palfreeman Trial in Bulgaria - Justice Impossible?

On a busy street corner in Sofia three years ago the lives of two families from Bulgaria and Australia were devastated after the murder of a young man. Can the court instill a sense of justice? By Milena Hristova

"You can hardly find pictures of Andrei, where he is not smiling," says Gabriela and her eyes fill with tears as she recollects the great times he and her best friend had together.

I don't really know the details of this case (apparently nobody does!), but I remember that when it was covered a couple of years ago it was clear of two things:

1. Andrei's father is very highly connected and an important figure
2. Andrei was a regular member of skin head groups

Neither of this is mentioned in this article, which strikes me as a little one sided in that it doesn't really question Andrei's supposed complete innocence.

The article says: "On a busy street corner in Sofia three years ago the lives of two families from Bulgaria and Australia were devastated after the murder of a young man. Can the court instill a sense of justice? Milena Hristova finds out the answer is no."

Stop this crap.

The Australian boy had and used a knife.

If he was a true hero, he would have used his fists, lost a couple of teeth and, settled the case.

Al,
A few years ago (maybe more than a few), I was in Ireland when it was reported that two UK soldiers took a wrong turn in Northern Ireland and ended up at a funeral of an IRA guy. Maybe it was not an accident they were there, but what happened was something that haunts me to this day. The soldiers were attacked and killed in their car by the crowd.
The interesting thing as it pertains to your comment about the knife?
One of the soldiers died with his gun in his hand. He had the chance and never tried to save himself by firing into the crowd.
I remember the photos in the paper that was published, showing them struggle for their lives.
None of this has anything to do with Palfreeman, but your comment brought back this memory.

Al,

I don't think anyone denies he killed the guy. The question is really at what point did he pull the knife and when did he stab the Bulgarian kid? Presumeably that was after they were throwing concrete slabs on him.

What I can't believe is that this guy simply walked over and stabbed the guy for the fun of it without being provoked. I find it really hard to believe that. Yet that is the version given by the family of the Bulgarian kid.

Of course the real problem is the way in which BG law has been bent and twisted in such a way that it just stinks of a cover up even if there wasn't one...

Australian case

Al,

I don't think anyone denies he killed the guy. The question is really at what point did he pull the knife and when did he stab the Bulgarian kid?
(He pulled the knife when he went to help the Roma according to his own admission)
(Monov was stabbed in the BACK and died, Sahariev was stabbed in the BACK but survived, I have never heard of anyone attacking by walking/running at someone with their BACK to them)

Presumeably that was after they were throwing concrete slabs on him. (They threw slabs at him, Palfreeman had no injuries after the fracas was over.)

What I can't believe is that this guy simply walked over and stabbed the guy for the fun of it without being provoked. I find it really hard to believe that. Yet that is the version given by the family of the Bulgarian kid.
(I find it easy to believe that excessive force was used by Palfreeman, he was the only one with a knife, and he used it against his opponents.)

Of course the real problem is the way in which BG law has been bent and twisted in such a way that it just stinks of a cover up even if there wasn't one...
(Agree 100%, it looks bad although for the most part the guy is getting off lightly)

The group that attacked the Roma and Jock (confirmed by 3 independant witnesses) also were the main witnesses that said they saw Jock stab Andrey

Their evidence is absolutely clear that Andrey and Jock were facing each other. There was never any evidence that andrey was stabbed in the back. While their testimony has now been shown to be full of lies (2 of them were shown to have changed their stories during the appeal court hearings) this is the only evidence presented to the court about how Andrey recieved his wound

For a full view of the defence arguments for Jock see the freejock website and make up your own mind. The prosecutor, civil claimants and first court have made no attempt to answer any of these arguments. In particular who was the group severly attacking on the ground near the subway as seen by independant witnesses at the Sheration). The group deny attacking anyone like that. This occurred 80 meters and several minutes before Andrey was seen falling to the ground on the CCTV(after having run in to the fight)

There were no other knives? None of the group of drunken men (remember Monov was 2.9 promil and Zahariev 1.9) were searched by the police. The men (Roam) who had the confrontation with the group (admitted by everryone) were never looked for by police.

Its clear the truth in this case will never really come out, as there are clear discrepancies in versions of events and questions about the conduct of the authorities.

However, I'd be interested in understanding the extent of the injuries presented in court to Palfreeman's head given that its been suggested that concrete slabs were thrown onto his head. Surely these injuries would have been very extensive and formed the cornerstone of the self defense argument?

It would also be interesting to understand exactly where the boys were stabbed - some say in the back, others say not - surely the coroners report is specific about the entry wound(s) to the dead boy and the Doctors report on the boy that received non-life threatening injuries?

And just exactly what kind of knife was being carried by Palfreeman? Size, make. model etc?

The truth will never come out because the drunk Bulgarian pig who got killed is the son of some VIP mutra who is "connected". This is an extreme case of nepotism.

Palfreeman claims he had been attacked a few times in Sofia in a short space of time which is why he carried a big knife (as well as a screwdriver apparently) when he went for drinks with friends. How come I've never been attacked on the streets of Sofia, and this guy was attacked a few times in a very short period? And this bad luck appears to follow Palfreeman around as he previously stabbed someone in self-defence in Australia.

It would be interesting to know how courts would perceive his actions if this had taken place in another country. If Palfreeman was in the US, Germany, UK, France or Netherlands etc, was carrying a big knife in order to protect himself, and got into a fight with drunks at a local bar, and stabbed in the back and killed one of the drunks, how would the court look at that? How would the court consider his confession that he usually carried a knife? The point is that in almost any country Jock would have been convicted.
