Bulgaria’s Supreme Administrative Court has upheld a ruling by the Consumer Protection Commission (KZP) which describes as unfair competition practice the attaching of ‘Refurbish’ or ‘Pre-owned’ labels to mobile devices sold by a local consumer electronics retailer.

According to the court, by attaching labels in a foreign language only and without translation into Bulgarian the retailer hadn’t provided adequate information to consumers that the devices they were buying weren’t brand-new, KZP said in a statement on Tuesday.
The practice could mislead the potential buyers of those mobile devices and influence their decision whether to make a purchase, the court has ruled.
Under Bulgaria’s Consumer Protection Law, information about the basic features of goods being sold in shops should be written in Bulgarian. The transliteration of ‘Refurbish’ in Cyrillic script on the label is unclear to the Bulgarian reader, according to the KZP.
Products offered as ‘Refurbished’ and ‘Pre-owned’ were not new; they had been sent back to the retailer by the original byuer for some reason and therefore their sale price was usually lower than the price of brand-new devices, the KZP has found.
Even though the devices carrying the labels ‘Refurbished’ or ‘Pre-owned’ had been thoroughly inspected and tested by qualified technicians before marketing to guarantee their quality, the retailer should have been explicitly informed potential buyers in a comprehensible way that the mobile devices had been recycled, according to KZP.
A fine of BGN 1,000 will be imposed on the retailer.
