The governing body of Bulgaria’s State Agency for National Security (DANS) has opposed the plans of the government to amend the DANS Act.
A bill tabled by center-right party GERB (Citizens for European Development of Bulgaria) envisages the return of anti-mafia unit GDBOP (Chief Directorate Combating Organized Crime) within the structure of the Interior Ministry and the appointment of DANS Chair through a presidential decree.
According to a media statement of DANS, the adoption of the legal amendments will block over 400 cases.
At the same time, the introduction of the appointment of a Chairperson of DANS through a presidential decree will signal lack of trust in Parliament, according to DANS.
At present, the head of DANS is appointed by Parliament at the proposal of the Prime Minister, while the legal changes stipulate that the person should be appointed by the President at the proposal of the Council of Ministers.
DANS insists that no arguments have been presented to justify the appointment of DANS Chair through a presidential decree and not by Parliament.
The proposal for the return of GDBOP within the structure of the Interior Ministry has been explained with, among other things, criticism on the part of the European Commission.
According to DANS, however, the criticism is leveled at the lack of discussion surrounding the restructuring of the entity and not at the measure itself.
