Bulgarian media tycoon Delyan Peevski, whose appointment as Head of the State Agency for National Security (DANS) triggered a wave of ongoing mass protests in Bulgaria, will not return to Parliament as MP on September 4.

The Bulgarian Constitutional Court (KS) still has not come up with a stance whether Peevski keeps his post of MP because of the large number of court officials on holiday and on business trips, according to reports of dnevnik.bg.

The Constitutional Court could not specify the date of the first sitting on the case.

The appointment of Peevski was referred to KS after MPs of the former ruling center-right party Citizens for European Development of Bulgaria (GERB) submitted a request for the termination of the MP term in office of the notorious media tycoon.

Peevski was appointed DANS Chair on June 14 but the appointment was cancelled by Parliament a few days after that.

The cancelled appointment brought up the question of whether Peevski could return to his previous post of MP from ethnic Turkish party Movement for Rights and Freedoms (DPS).

GERB MPs insist that by signing his oath of office as DANS Chair on June 14, Peevski assumed the post of DANS Chair, while the Parliament had not voted on his resignation as an MP which he had submitted earlier the same day. As a result, Peevski is said to have assumed two incompatible posts.

The Constitutional Court was asked by GERB MPs and 93 MPs from the Bulgarian Socialist Party (BSP) and DPS to interpret Article 72 of the Constitution on the termination of the term in office of an MP in the case of incompatibility of posts or ineligibility.

After Peevski's appointment was cancelled, DPS said that he would not show up in Parliament and receive a salary as MP until KS came up with a ruling on the matter.
