Declaring a crisis situation in Sofia over the waste removal problems is illegal, Bulgaria's Supreme Administrative Court ruled Thursday.

The magistrates further annulled the Cabinet's decision to create waste crisis headquarters, basing it on the Law, which stipulates the establishment of crisis headquarters can be done by the order of the Prime Minister not the Ministries Council.

At the end of April, the Supreme Administrative Court refused to halt the establishment of the waste crisis headquarters, but the City Hall appealed the decision and another team of magistrates revoked the crisis situation Thursday.

The Law states that in order to declare a crisis a change of the established way of life over territories, facilities, sectors and areas of the economy must occur, triggered by human activities or natural disasters that would result in the significant disturbance of the living conditions or conditions to conduct activities.

According to the magistrates, there is no evidence and proof of such disturbance as far as Sofia's waste removal is considered, to the contrary, measures to deal with the situation have been undertaken.

It was the crisis headquarters that mobilized five cleaning companies and paid them BGN 1,4 M to collect the trash parallel with the City Hall contractors.

Legal expert say that with the latest Supreme Administrative Court rule, the companies hired by the crisis headquarters could be asked to refund the money they received.
