Court procedures have not been violated by authorities during their attempt to take away the two Bulgarian children from their father in Asenovgrad.

The information was revealed through a checkup of the case, conducted by the Chamber of Private Bailiffs and announced by the Chamber's Chair, Georgi Dichev, upon conclusion of his meeting with Justice Minister, Meglena Tacheva.

The dramatic custody battle between the Polish mother and the Bulgarian father entered the media spotlight on May 28 when the mother attempted to seize the 8-year-old Nikoleta and 7-year-old Pavel from their father.

The parents are separated, but not divorced. The children refused to leave with their mother, which led to the involvement of the local police, court authorities and a representative of the social services in the town.

A fight broke out while the authorities attempted to take the children. Pavel managed to escape and his whereabouts are unknown.

The checkup revealed that as early as April the bailiffs have ordered the children to be taken away from their father. At the time the police have declined to take part in the seizure. Dichev defined accusations against bailiff, Kremena Dermendzhieva, of attempting to take the children by force, as completely unfounded, adding her actions were perfect and she had not, in any way, violated the procedure.

The case has been examined Friday during a special session of the Chamber of Private Bailiffs. Dichev said from all legal procedures similar cases were the most difficult ones, adding parents bear huge responsibility to not turn their children against the other spouse.

According to Dichev, there are about 100 such cases in Bulgaria at the moment and they will grow considering how many Bulgarians went to live and work abroad in the last years.

A bailiff receives BGN 50 as compensation for working on a case like the Asenovgrad one.

Dichev and Tacheva had discussed the idea of appointing special bailiffs to only deal with custody cases and for the Main Directorate "Court Security" at the Justice Ministry to assist the bailiffs when parents' rights are involved.

On Monday the father, Todor Vasilev, produced the written document, signed by the mother in the presence of the Bulgarian Consul in Warsaw, giving him permission to take the children to Bulgaria. Todor claims the document is unconstrained, but Bulgarian authorities say it was valid only for one summer vacation.
